This morning, I would like to spend a few minutes discussing the issue of intellectual property rights (IPR) – specifically, the IPR crisis that so many of our citizens are facing and discussing.

The president also outlined a continuing policy of addressing intellectual property issues in parallel with other, more traditional trade issues as a means of demonstrating the high priority that IPR represents for the United States. This is particularly true in the context of China’s burgeoning market economy, in which intellectual property rights are among the most important enablers of economic growth. Indeed, China is not the only country in this situation–its rising economic strength has brought new competition for American business, and counterfeiters are challenging U.S. firms to meet and survive in the new marketplace. Ultimately, the steps we have taken to stop piracy and counterfeiting in China have helped U.S. firms to compete for sales and recognition in China, and vice versa. But the American government will continue to work with China, as it does with many of its trading partners, to address its concerns about counterfeiting and piracy. And it will continue to take every possible step to ensure that Chinese firms and their intellectual property rights are fully protected in this increasingly interconnected global marketplace.

Another strategy that the United States has used to combat counterfeiting is to impose tight sanctions on countries that fail to address their counterfeiting problems. In 2004, for example, the United States added China to a list of countries with a record of trading counterfeited goods. And we recently used the WTO TBT decision to strengthen the reach and effectiveness of the United States ability to stop counterfeiting and limit its negative impact on trade in the United States. These actions have forced China to change its policies. China has agreed to take a series of steps to strengthen its enforcement of counterfeiting laws, to promote oversight of its counterfeit markets, and to clamp down on violations of intellectual property rights. And we have strengthened the ability of the U.S. and other trading partners to help China address its counterfeiting problems. When China participates in international forums to address IPR issues, it has come under more pressure to adopt more effective policies.
