After briefly reviewing some of the relevant legal and ethical principles in the 1953 Code, Mautz and Sharaf concluded that it was not, that this conduct was also inconsistent with auditor independence, and that it was of the same character as the situation where an auditor is delegated the responsibility of personally helping clients attempt to get favorable tax treatment.
The key question, as Mautz and Sharaf framed it in their 1958 paper, was, “What is the difference between a doctor’s delegating a part of his practice (perhaps all of it) to another person and the client who may, perhaps, feel his doctor is unfair to his side of a professional argument?” Mautz and Sharaf concluded that only a very slight difference exists, and that there was no mutuality of interest of the type necessary to impinge on auditor independence. They also pointed out that some auditors actually refrain from such conduct in their personal relationships. Further, they noted that many outside advisors to management, especially accountants who prepare the audited financial statements, are occasionally requested to express opinions to management on the risks involved in the items included in the financial statements, and that this is not inconsistent with auditor independence.
Mautz and Sharaf contended that the current practice of accounting offices delegating a part of their audit practice was very common and that the staff auditors’ independence had to be considered very robust. They pointed out that accountants are licensed to practice law and that the practice of a lawyer is very different from that of a doctor, and concluded that the strong professional self-interest of a certified public accountant takes care of the problem.
