MEMORANDUM AND ORDER
BODY, District Judge.
Defendant, the now defunct Bermuda Star Line, Inc. (“Bermuda”) has moved to dismiss this action as to it.
Defendant argues that its successor company, United States Lines, Inc. (“United States”), is an indispensable party to this action and that its joinder as a party is necessary for the fair and efficient adjudication of this matter.
The law of admiralty in this jurisdiction, at the present time, is clearly established. In short, when it is possible to obtain jurisdiction over a defendant, “it is not a want of power in the federal courts to assert that jurisdiction, but an election to assert it.” 1 Knauth, Benedict on Admiralty (6th Ed. 1940), § 72, p. 339. Also, to the extent that Rule 19, F.R.Civ.P. is in conflict with Rule 42(b), F.R.Civ.P., the former is controlling and, as regards the dismissal of an action, controls the “cogent and dominant reason” of the last sentence of Rule 19.
