a detailed methodology is provided in the report. for sources used to compile the overview, the icj has adopted a standard methodology to determine the credibility and the reliability of the sources: (a) comprehensive and critical review of sources; (b) purification of sources through editorial practices such as selection, verification, and cross-referencing; and (c) cross-checking of sources to ensure their reliability. based on these considerations, we maintain that the sources used in this report are reliable, credible, and representative of the situation in vietnam.




censorship is also widespread in vietnam. the government blocks pornography and celebrity gossip websites. the government has also blocked an interactive map created by the american security firm recorded future in vietnam and multiple other countries, amid concerns that the site incites terrorism. ethnic minority groups, including the hmong and cham people, are often targeted for abduction. the government also tightly controls religious freedom, leading to a large underground christian community. in june 2019, the state accused an evangelist of spreading “harmful religious propaganda” and the government banned his activities. although strict controls are present, internet penetration has increased since 2015 as the government relaxed censorship. life in vietnam is better under the current regime than it has been under the communist regime. following the 2016, resulting in an exodus of many vietnamese people. the vietnamese government requires private companies to assist it in investigations. decree 72 gives vietnam the right to inspect businesses’ servers, and requires companies to help authorities investigate crimes and violations of the law. it also empowers provincial people’s committees and public security departments to inspect and confiscate computers, tablets, and other devices, though they may not use them for illegal activity. ownership of seized devices must be disclosed to authorities, who may then resell them to others if they so desire. in practice, these powers have been used to collect evidence for criminal proceedings, though recent legislation to give prosecutors greater authority over domestic investigations does not foresee cross-border evidence collection. 8 decree 72 requires telecommunications, internet, and social media networks to provide personal information about users in response to requests from competent authorities; uses an ambiguous term to refer to such requests; and provides minimal oversight over the collection, storage, and provision of information. decree 72 requires providers such as social networks to provide personal information of the users related to terrorism, crimes, and violations of law to competent authorities on request, but lacks procedures and adequate oversight to discourage abuse. article 1 states that networks must store information of users for a minimum of two years; the precise limits of this obligation are unclear. 5ec8ef588b
